This bill proposes changes to the existing Idaho state law aimed at preventing materials such as images, books, magazines, and other visual or written content deemed inappropriate, harmful or sexually explicit from being made available to individuals under the age of 18 by schools or public libraries. This proposal provides a wider and more specific definition of what is deemed 'harmful to minors', which includes various forms of nudity, sexual conduct or stimulation, and sado-masochistic abuse. It also includes a provision stating that a minor who obtains such materials, or a parent or legal guardian, can take legal action against the institution if it's proven that the institution failed to limit access to such content. Furthermore, the institution can avoid liability if they can demonstrate reasonable belief that the minor was 18 years or older at the time, or if the minor was with a parent or legal guardian. The bill gives the attorney general or county prosecuting attorney the power to take legal action for injunctive relief against any school or public library violating these regulations. This bill will be in full effect from July 1, 2024.
