Thanks to last year’s Supreme Court ruling in 303 Creative v. Elenis, a wedding photographer’s free speech case against New York is moving forward. Emilee Carpenter is challenging a New York law that forces her to express messages in violation of her faith. If she doesn’t create such photos and blogs, New York’s law threatens her with fines of up to $100,000, a revoked business license, and up to a year in jail. Now, based on 303 Creative, the 2nd Circuit has ruled that the district court must consider Emilee’s free speech claims. We will ask the court to prevent the state from forcing Emilee to express messages against her beliefs. “As the Supreme Court reaffirmed in 303 Creative, the government can’t force Americans to say things they don’t believe,” said ADF Legal Counsel Bryan Neihart. “The U.S. Constitution protects Emilee’s freedom to express her own views as she continues to serve clients of all backgrounds and beliefs.” We urge the district court to uphold this freedom and follow Supreme Court precedent. The same First Amendment that protects Emilee Carpenter protects all of us—no matter what we believe.

ANOTHER VICTORY FOR TITLE IX: The Biden admin’s illegal attempt to rewrite Title IX saw another setback today. A federal court granted a Texas school district’s request to block the rule change while litigation continues. Of ADF’s 5 current lawsuits, this is the 4th injunction we’ve obtained to stop the Biden admin from redefining “sex” in Title IX. In the lawsuit, we’re representing Carroll Independent School District, which does not want to be forced to allow males into girls’ restrooms, locker rooms, or showers. The district also objects to enforcing policies which would restrict the free speech of its students and employees. Now, all schools and students in the district will be protected while the case continues. We’re proud to stand alongside Carroll Independent School District in defending reality, common sense, and student safety.

BREAKING 🚨 Female athletes appeal their cases to SCOTUS Today, together with the AGs of WV and ID, we asked the U.S. Supreme Court to hear two cases on women’s sports. Our clients are female athletes seeking to protect fairness and safety for women and girls. Both cases involve states—West Virginia and Idaho—which enacted laws to protect women’s sports. But federal courts have put those laws on hold, preventing their full enforcement. In B.P.J. v West Virginia, a male athlete has competed on a girls’ middle school track and field and cross-country teams for three years, finishing ahead of almost 300 girls. Our client, Lainey Armistead, intervened in the lawsuit to defend WV’s law. In Hecox v. Little, our clients, Madison Kenyon and Mary Kate Marshall, were forced to compete against a male athlete while running track and cross-country at Idaho State University. Both were pushed down in the rankings as a result. They are defending ID’s law alongside the state. Preserving women’s sports should not be controversial. Girls deserve to be champions in their own sports, and they deserve laws that reflect common sense. We urge SCOTUS to give them that fair chance.
