The Framers understood presidents to be accountable to the people and to the laws, and explicitly recognized that criminal prosecution would be one way among several to hold them accountable. Fifteen members of the Historians Council on the Constitution filed an amicus brief explaining the historical problems with granting criminal immunity to presidents. I spoke to Taylor Lorenz at the The Washington Post about some of the novel campaign finance issues that arise from the growing role of online influencers in political campaigns—including the subject of her story, an influencer who is also her party’s nominee for Senate. Most of the rules in this area date back to the early 2000s, when social media was in its infancy, so there is a lot of gray area. We are going to see more and more questions as the role of influencers in public life expands and campaigns move increasingly online.

Today I'm quoted in this Gothamist story about Chief U.S. District Judge Laura Swain's decision to set a hearing on whether to hold New York City officials in contempt for chronic noncompliance with a 2015 consent decree requiring them to take several steps to mitigate a spate of longstanding constitutional deficits (particularly violence) plaguing Rikers Island. One consequence of a contempt finding could include a judicial takeover of the troubled NYC jail system. In fact, that is exactly what happened two years ago to the Hinds County, Mississippi jail. After twice finding the local Mississippi leaders in contempt for substantial noncompliance with a 2016 consent decree designed to improve conditions in their local jail, U.S. District Judge Carlton Reeves seized control of the correctional facility.
