This morning, the Department of Labor published its long overdue Final Rule on worker classification under the FLSA. This rule - while being framed as “new” - is mostly a reversion to pre-2021 guidelines for worker classification. The headlines are beginning to treat this as a blow to flexibility and the gig economy. Some gig workers are protesting it as a limit on their ability to work flexibly. This is being framed as “flexibility” vs. “employee” classification. At connectRN, we have proven that both can be true. We built a gig platform for nurses and CNAs that provides radical flexibility for our users. From launch, we have classified all of the users on our platform as W2 employees. All of our users benefit from the worker protections afforded them as employees, and our partner facilities benefit from knowing that the workers that they hire are compliant with FLSA and other employment standards. Building our platform in this way involved meaningful tradeoffs. We have paid tens of millions of dollars in employer Social Security and Medicare taxes. We have contributed millions more to unemployment insurance taxes, paid family medical leave, and earned sick time programs. I estimate that 40 to 50 percent of our R&D investment over the past 7 years directly relates to our effort to be compliant with employment law. And it has been worth it. We have built a gig platform that provides workers with both the flexibility that they deserve and the protections that they are entitled to under the law. We have made both true. Big News in #HealthcareStaffing today: https://bit.ly/3RWGQuK. The Department of Labor just issued its final ruling on the definition of independent contractors vs. employees. This debate, centered around W2 vs. 1099 clinician classification, has been dominant, and at times confusing, over the past year. Many operators will need to reclassify their existing relationships with independent contractors. This mandate further confirms what we’ve always believed, which is that classifying clinicians as W2 employees is the best way to support per diem healthcare workers. We learned earlier this year that #nurses are looking at ways to stay in the profession they love while still exploring new paths. In a recent survey of 1300+ nurses 34% said they are in pursuit of new skills and/or are following a passion while more than half are motivated by their future potential and want to continue their education, but can’t due to the lack of flexibility in their schedule. Transitioning specialties as a #nurse takes a lot of gusto to step out of one’s comfort zone to grow, both personally and professionally, while providing quality care for patients. In 2017, after many years of working with adults, I made the leap to work in the only #pediatric #emergencydepartment in San Francisco. I was scared of how small and critical the kiddos were. How experienced my colleagues were. And I had no idea how to talk to a scared parent. I can confidently say that making the transition, facing my fears, and furthering my nursing skills was one of the most rewarding experiences of my career. Luckily, I had phenomenal leadership at UCSF Health to guide me through the transition. Between didactic classes, many preceptors, and regular check-ins with my managers, I felt like I was given all of the tools I needed to succeed.
