Twardy, a former U.S. Attorney for the District of Connecticut, commented that the steady escalation of the investigation is evidence of a serious inquiry, stating, "They are taking it very seriously. It went from just the FBI and the DOT to getting the U.S. Attorney's Office involved, because that's where the grand jury subpoenas come from. Clearly, they're taking it very seriously." The future of the FTC's noncompete rule is uncertain following a Texas federal court's preliminary injunction on July 3, which delays the rule's effective date for the plaintiffs in the case. The FTC's rule, issued in April, bans nearly all noncompete agreements and is set to take effect on September 4 for other employers. The court questioned the FTC's authority and found the rule overly broad and arbitrary. Learn more about how employers should prepare for the rule's potential implementation in our recent alert authored by R. Scott Beach, Brian Fischer, David Waizer, Lane Watson. #FinCen #CTA #CorporateLaw
