In June, our Litigation department hosted in-person retreats on both coasts: one at the Los Angeles office, and another at the New York office. Each retreat featured a diverse range of substantive CLE programs, including preparing witnesses for depositions, examining mediation strategies and effective conflict resolution, managing real estate litigation, and reviewing arbitration advocacy strategies. In addition to training and skills development, the retreats were designed to provide opportunities to network and spend time with colleagues. In 2020, the King for Congress Committee used the “Success Kid” meme for fundraising, posting it on its website and social media. Originally photographed by plaintiff Laney Griner in 2007, the viral image of her 11-month-old son was copyrighted and licensed for commercial use. Griner sued for copyright infringement, and the jury awarded her $750 in damages, the statutory minimum. On appeal, the Eighth Circuit affirmed the verdict, rejecting the committee’s fair use defense. The court held the use was purely commercial, aimed at soliciting donations, and lacked compelling justification. It also found the committee used the "heart" of the work—the image of Success Kid himself. Read more about the decision below.
