Healthcare providers are facing penalties for blocking access to a patient’s electronic health information under a new Biden administration rule. Hospitals in the Medicare Promoting Interoperability Program risk losing financial incentives if they engage in "information blocking." Accountable Care Organizations could be banned from the Medicare Shared Savings Program for at least a year. HHS Secretary Xavier Becerra emphasizes the rule's goal: ensuring patient access to health information. Despite provider requests, there's no appeals process for penalties. Fines could reach $394,000 for hospitals and $686 for individual providers. The Nelson Mullins team is experienced in healthcare regulatory matters.
