UPDATE RE FTC RULE BANNING NONCOMPETES: Today, plaintiff and plaintiff-intervenors asked the Texas federal court to reconsider the scope of the preliminary relief it granted on July 3rd in enjoining the FTC from enforcing its final rule banning noncompetes. Recall that the July 3rd Order surprisingly limited the remedy to only the named plaintiffs—it was not nationwide. Now, plaintiff and plaintiff-intervenors persuasively argue—with compelling Fifth Circuit authority—that an order preliminarily enjoining an unlawful regulation or staying its effective date under the APA need not be party-restricted. An order granting this motion for reconsideration would be hugely impactful.

This article, written by Deutsch Kerrigan attorney Jose R. Ruiz, outlines the Louisiana Supreme Court’s May 2024 ruling in Bennett vs. DEMCO Energy Services, LLC. The Court decided that a defendant’s contractual claim for defense and indemnity against a co-defendant or third-party defendant is not legally “premature” and can be asserted during ongoing litigation. This decision resolves a conflict among appellate courts, clarifying confusion from the 2005 Suire v. Lafayette City-Parish Consolidated Gov’t case. Previously, the First Circuit deferred such claims until liability was established, while other circuits allowed them during litigation. The Bennett ruling promotes judicial efficiency and will significantly impact future defense and indemnification claims. Trust accounting compliance is a major issue for solo and small firm lawyers, often leading to disciplinary or malpractice issues. Now, the State Bar of Texas and Smokeball - Legal Software are announcing a partnership to provide free trust accounting and billing software to every lawyer in Texas, some 111,000 lawyers. Having access to the right software is a major step towards reducing compliance-related issues.
