Starting July 1, 2024, new Colorado legislation will restrict employers from certain actions during the job application and hiring process. The Job Application Fairness Act (“JAFA”) restricts employers from asking about a job applicant’s age, date of birth, or dates of attendance/graduation at educational institutions, with limited exceptions for legal and safety needs. JAFA covers all employers in Colorado regardless of industry, public or private sector, or size. There was an interesting hearing in the Senate yesterday... Employers might want to pay attention to this one 👆 After about an hour of testimony and disposition regarding a high-profile sexual harassment case that was shut-down due to Forced Arbitration clauses and a subsequent firing of a nurse for Stuart Health who was very clearly let go because of age, Senator Lindsey Graham and the Senate are looking like they will be going to put into place a law that prohibits these forced arbitration clauses for employers specifically. It was acknowledged, and I happen to know personally, that sometimes mediation and arbitration is the better, cheaper and most effective solution in a legal battle. So the Senate 🏛 wanted to make it clear that this does not eliminate arbitration from the legal system. Moreso, it (rightfully so) prohibits employers from including clauses that state the employee must waive their right to a trial by jury in the case of any legal disputes. Also, makes an attempt at eliminating ageism, but I'm skeptical about that efficacy. Regardless, I think this is a big win for 😎 America, even as a professional who specializes in hiring, any clause that forces me to waive my rights just irks me. So, props 👏 to the Senate. Employers might want to start 🔎 reviewing employment contracts, or you can hire me to do so! 😂 I'm sure more than half of all employers in America have some sort of severability or forced arbitration clause in their contracts. From what I saw last night, that's going to be an illegal clause in any employment contract moving forward 😅 And from what I've seen in the market recently 🙈 upcoming law grads might want to look towards Labor & Employment law as a profession 🤑
