The Am Law vetting process for lateral partners is 25% longer than before. Law firms are delving into the prospective lateral partners' portable book of business and clients and requiring them to meet more law firm partners during the interview process. At Lateral Link, we have been monitoring these changes and have spent much time working closely with our Am Law clients to understand their strategic lateral partner needs and the unique opportunity for prospective lateral partners. In particular, we work with our trusted clients to understand the firm's partner compensation, origination credit systems, and lateral partner integration plan and share the information with lateral partner candidates. We track and analyze partner hiring across our markets in real-time, or as close to it as possible - and what the January and February data revealed was certainly newsworthy. As The American Lawyer reported, “In the first two months of 2024, lateral partner hiring in the Am Law 50 has already surpassed the same periods in 2022 and 2023, especially in corporate practices, where firms are seeking to get ahead of a return in transactional activity. With #litigation activity on the rise, some #BigLaw partners are finding it tough to corral the associate support they need. As New York Managing Director Rose Corbett told The American Lawyer, she’s worked with candidates who are “specifically evaluating firms on the basis of the quality and how plentiful associate support is," noting that "multiple firms" are struggling with the balance. "As a recruiter, I have to know where the support is,” Corbett said. “That is one of the more active questions. I’m doing my job well if I can steer candidates toward opportunities that can satisfy their associate needs.” #lawfirms #partnerrecruiting #amlaw50

#ABA Formal Opinion 510: To minimize risks of disqualification of the entire firm, law firms should carefully evaluate their policies and procedures for dealing with prospective clients under Rule of Professional Conduct 1.18 in light of ABA Formal Opinion 510 (March 20, 2024). Under the opinion, an entire law firm may be disqualified from undertaking representation against a former prospective client even if the lawyer who interviewed the prospective client is screened from the matter if the interviewing lawyer “learned too much” about the prospective client’s matter: “ #Lawyers must limit the information sought from prospective clients, and those who seek and obtain information without limitations fall short of that standard.” Because interviews with prospective clients pose risks of disqualification in subsequent matters – disqualification of both the interviewing lawyer and of the entire firm -- conflict checking procedures may need to include prospective clients even if they do not retain the firm. My sense is that this is not standard procedure with most firms.
