If this decision stands, then I could see IP law being drastically overhauled at the legislative level. The powerful players that lead the media, news, and entertainment industries will exert their influence to ensure they can have their cake and eat it too (i.e., replace as many of their human creators as possible with AI, but still claim copyright protection for the works that AI creates). #ai #genai #llm #copyright #ip #intellectualproperty

Good Sunday morning. Hope you had a good recommended hours of circadian rest. A USA federal judge ruled that an AI artwork can not enjoy copyright right protection on Friday. In order for copyright protection to be applied, there must be a human in the loop. AI does not have legal personality on its own. It will be interesting going forward, how much human is required for the work/works to be entitled copyright protection? And the gaps that will be exploited as many more copyright issues will arise with the use of AI. #copyright #intellectualproperty #AI #legalpersonhood

Iconic actress Keira Knightley intends to file for copyright on her image because of concerns, which she called "potentially catastrophic," related to the rise of artificial intelligence in the cinema world. In the lack of effective regulations and a thorough legal discussion of the responsibilities of generative AI software, Knightley's move could prove to be effective not just from a media perspective, as the positions of the U.S. Copyright Office appear consistent with protecting pure 'authorship'. This decision follows the current writers' and actors' strikes in the U.S., the first together in over 60 years, started by the use of AI, both in filming and editing, by historical productions and newer ones such as Amazon, Netflix and Apple. The increasing use of deepfake technology for purposes such as advertising and pornography, even with the integration of voice cloning, allows the creation of real artificial alter egos comparable-at least virtually-to the originals. In this regard, in addition to calling for global legislative interventions that take into account the protection of fundamental rights, the role of lawyers is important in forcing platforms and users to restore violated rights, as well as enabling the integration of this extraordinary technology with a society that knows how to use it. 📸 Andrea Raffin
