From Vinson & Elkins: On February 26, 2024, the United States Supreme Court is set to hear oral argument in two cases currently before the Court, Moody v. NetChoice and NetChoice v. Paxton. At their core, these cases raise the question as to whether the First Amendment prohibits state laws restricting “social media platforms” from engaging in content moderation and making editorial choices about whether and how to publish speech on their platforms. Content/copyright owners need to protect their IP. Careful and specific licensing terms, defining scope of rights and ownership of "new" content created from licensed IP, should be one goal. Litigation for unauthorized taking and use of IP should always be a possible response if no license is entered into or one is being violated. Doing nothing, and watching your IP being accessed and in some way used and/or transformed, ought not to be the response. https://lnkd.in/eSXBzdtQ

Is this the tipping point for online news outlets? Google's evolving #generativeAI tools that can summarize stories published by the news media are creating increased anxiety for the Fourth Estate. It will be interesting to see whether such technological advances reduce or increase traffic to news sites and whether such algorithms violate the rights of news publishers and copyright law.

The Digital Services Act creates a complex architecture, enabling users to complain and seek redress when they encounter allegedly illegal online content. Yet, to date, we know remarkably little about user psychology in this context. What influences the users' decision whether to report content? How do users conceive of their role within the content moderation framework? And how much do they trust platforms and their content moderation policies? To answer these questions, hopefully paving the way for data-driven law enforcement and regulation, I carried out an experimental study together with Sarah Vahed (who took the lead on the project and coordinated our efforts), Catalina Goanta and Alan Sanfey. Here's a fascinating interactive chart showing the degree of left-right skew and reliability of thousands of media: https://lnkd.in/g_pxN_np. (Full disclosure, one of the many contributors to the chart was Purdue Global Law School adjunct professor Steven Specht). Much of it confirms what many would already suspect: (1) overall, more media sources skew left than right; (2) most "mainstream" media (e.g. CNN, BBC) skew left, and (3) some of the least reliable sources tend to skew very far right (e.g., Alex Jones). It would be interesting to see a chart of just the coverage of the Israel-Hamas war. I would suspect more polarization (and a stronger leftward skew) than is seen for reporting overall. Any views expressed herein are my own and do not necessarily reflect those of my employer.
