Judge Aileen Cannon just dismissed the classified-documents case. She concluded that Special Counsel Jack Smith’s appointment violates the Appointments Clause of the U.S. Constitution. She issued a 93-page opinion in support of her conclusion. I pull out key excerpts—and welcome reader comments—in this post on Original Jurisdiction. https://bit.ly/4d2TYaG #Trump #DonaldTrump #law #legal #lawyer #lawyers #judge #judges #judiciary #Constitution #ConstitutionalLaw #ConLaw #JudgeCannon #AileenCannon #JudgeAileenCannon

In light of how originalism is the dominant methodology at the U.S. Supreme Court, it’s more important than ever to understand the originalist mindset. And if you’re looking for help on that front, I have a book recommendation: Professor Randy Barnett’s new memoir, A Life for Liberty: The Making of an American Originalist. As promised by its subtitle, the book provides excellent insight into originalism as a theory. But as an engaging and enjoyable memoir, it’s far more fun to read than any casebook or treatise. What drew Randy Barnett to originalism? Why does he view his losses in two landmark Supreme Court cases—Gonzales v. Raich, a Commerce Clause challenge to criminalizing medical marijuana, and NFIB v. Sebelius, a nearly successful effort to topple the Affordable Care Act—as victories of a sort? Why did he decide to write a memoir—and why does he think you should, too? All this and more is revealed—on the latest episode of the Original Jurisdiction podcast. Thanks to Randy for joining me, and thanks to NexFirm for sponsoring. https://bit.ly/3VVIQFT #podcast #podcasts #podcasting #SCOTUS #SupremeCourt #law #lawyer #lawyers #attorney #attorneys #legalcareer #legalcareers #libertarian #libertarianism #originalist #originalism NexFirm Admin Encounter Books

Happy Pride—and (belated) happy June 26. As the Supreme Court hands down its final decisions of the Term over the next few days, it’s worth reflecting on how June 26 is the day the Court issued three of its landmark gay-rights decisions: Lawrence v. Texas (2003), United States v. Windsor (2013), and Obergefell v. Hodges (2015). Obergefell was issued in 2015, the same year that my husband Zach and I got married. And I would say that we—and really all married same-sex couples in the United States—owe a debt of gratitude to my podcast guest for today: Evan Wolfson, founder of Freedom to Marry, the groundbreaking campaign that won marriage equality in the United States and ignited a global movement. Evan has garnered many awards for his work over the years, including recognition as one of the 100 most influential lawyers in America by The National Law Journal and one of the 100 most influential people in the world by TIME magazine. What led Evan to focus his career on the fight for same-sex marriage? What was his thinking in launching Freedom to Marry? What are some secrets of the success of the marriage-equality movement? And what lessons can it offer to other struggles for social justice? Check out our conversation via the link below to learn all this and more. Thanks again to Evan Wolfson for joining me, and thanks as usual to NexFirm for sponsoring! https://bit.ly/3zrZDIO #podcast #podcasts #podcasting #LGBT #LGBTQ #marriageequality #freedomtomarry #samesexmarriage #gay #gaymarriage #SCOTUS #SupremeCourt #law #lawyer #lawyers #attorney #attorneys #legalcareer #legalcareers

NexFirm is the proud sponsor of Original Jurisdiction podcast with David Lat. To close out #LGBTQPrideMonth, David chats with Evan Wolfson, senior counsel at Dentons and widely regarded as the architect of the marriage-equality movement this Wednesday, June 26*. Evan is the founder of Freedom to Marry which staged the campaign that succeeded in winning same-sex couples the right to marry throughout the United States, and author of Why Marriage Matters: America, Equality, and Gay People’s Right to Marry. Listen to learn how Evan became interested in same-sex marriage, as a student at Harvard Law School in the early 1980s; his early career as a lawyer, including his work as a prosecutor; why he founded Freedom to Marry and focused his work on marriage equality; and what lessons other social movements can learn from the successful fight for the freedom to marry. Don’t miss it. https://loom.ly/JabwA1Y *A fitting day- June 26 is the day the Supreme Court handed down three of its most important gay-rights decisions: Lawrence v. Texas, the 2003 case holding anti-sodomy laws unconstitutional; United States v. Windsor, the 2013 case holding Section 3 of the Defense of Marriage Act unconstitutional; and Obergefell v. Hodges, the 2015 case holding that the Constitution protects the right of same-sex couples to get married. All three of these opinions—all from Justice Anthony M. Kennedy, by the way—were issued on June 26 of their respective years.

A few months ago, we learned about a misconduct complaint filed by a law clerk against a Second Circuit judge. The investigation concluded that the unnamed judge had an "overly harsh" management style, but ultimately dismissed the complaint because the judge agreed to various remedial measures. Who is the judge in question? It has been widely known around the courthouse for weeks. And what broader lessons about clerkship culture can we take away from this complaint and how it was handled? With clerkship application season getting underway on Monday (at least for judges who follow the Law Clerk Hiring Plan), it's a timely topic. https://bit.ly/4ef92Ds #law #legal #lawyer #lawyers #legalcareer #legalcareers #supremecourt #federalcourt #federalcourts #ethics #judiciary #judicial #judicialethics #judicialreform #clerk #clerks #clerkship #clerkships #clerking
