GMR Senior Counsel Cory Bonk obtained a favorable jury verdict after a three-day trial in New Jersey. The plaintiff sued Bonk’s clients for multiple intentional torts, including malicious prosecution, false light/invasion of privacy, and emotional distress stemming from a dispute between neighbors. The plaintiff also sought punitive damages. Bonk successfully obtained summary judgment dismissals of the false light and emotional distress claims but proceeded to trial on the malicious prosecution claim. Prior to trial, the plaintiff’s demand was more than $150,000. The jury returned a verdict for only $8,000, which essentially amounted to the plaintiff’s claimed out-of-pocket expenses and was significantly lower than the pre-trial settlement offer. Plaintiff then insisted on proceeding to the punitive damage aspect of the trial, and the Middlesex County jury unanimously agreed to a “no cause” in favor of the defense. The New Jersey Appellate Division offered a great road map for litigators engaged in medical malpractice actions on how to handle affidavits of merit (AOM). In particular, the case highlights that procedural rules are just as important as substantive rules. In Wiggins v. Hackensack Meridian Health, the plaintiff sued a doctor who specialized in both internal medicine and gastroenterology. The plaintiff served an AOM from only an internist. What interested me about the case first is the thorough overview of AOMs. Surely, this case has to go in every Garden State medical malpractice attorney's file. But the Appellate Division also noted that a critical transcript didn't exist and the plaintiff did not make a clear application to waive the kind-for-kind requirement of medical specialties. The plaintiff might be holding the correct substantive cards. But procedurally, the case made it to the Appellate Division in a posture more favorable to the defendants. Though the Court remanded, leaving the door open a crack for the plaintiff, this litigation is more money on the street for the plaintiff. She may succeed in the end, but at great cost. Lesson: Make sure you know the procedure as well as the substance.

It’s crucial to tell insurers about potential claims even before there has been a specific demand made, according to HSW partner and general counsel Evan Bolla's latest article for the New York Law Journal, which analyzes a Second Circuit decision involving professional liability insurance. The case, Pine Management v. Colony Insurance Co., involved rental apartment company Pine Management, which purchased professional liability insurance from Colony Insurance Co. while facing a lawsuit over alleged mismanagement. But when a letter from the plaintiff's attorney alleging wrongdoing was referenced in the complaint, questions emerged over whether that letter constituted a claim that fell outside of the policy's coverage limits. The appellate panel found it did, concluding that the insurer was right to deny coverage. Evan’s article considers the ruling’s implications and practical takeaways for policyholders, including: · Regularly review your policies to understand key terms like "claim," "notice" and "reporting requirements." · Establish clear internal protocols for reporting potential claims. · Document all communications and incidents that could lead to claims. · Report potential claims promptly, especially during policy renewals. · Know the last date for reporting claims under an expiring policy and consider an extended reporting period if needed. Motions for reconsideration are used in New Jersey under the right circumstances. A motion for reconsideration is a legal document filed after a court decision that allows parties to ask the judge to reconsider the outcome of a case. However, they cannot be used just because a party disagrees with the Judge’s decision.
