Spark Good Customer Terms of Use

By interacting with Walmart Spark Good programs, you agree that you are observing  Walmart.com Terms of Use and subject to the following terms:

  • Walmart does not share identifiable customer information with a Charity or NCES school.
  • In the case of round up donations and registry donations, only a unique identifier and donation for accurate reporting purposes are shared with the Charity or NCES school.

Spark Good Round Up

Walmart works with two organizations (Deed and Network for Good) to ensure that customers have a broad choice of Charities and NCES schools, and that there is a well-defined manner to disburse Round Up funds to the customer’s preferred organization. By participating in Round Up, customers understand that:

Any participation in Spark Good Round Up is subject to the following additional terms:

  1. You are donating to Network for Good-DAF (NFG-DAF), a donor advised fund sponsor. NFG-DAF is a Delaware nonprofit corporation and a Section 501(c)(3) tax-exempt organization (EIN: 68-0480736). Network for Good has exclusive legal control over your donation. Your donation is subject to Network for Good's Charitable Solicitation Disclosures and Network for Good's Privacy Policy. Network for Good, in its sole judgment, may grant donated funds to the recommended charity you have selected.
  2. Donation disbursements from Network for Good to eligible Charities or NCES schools will be made on a quarterly basis, approximately 15-20 working days after the end of the quarter. Quarters are defined as January-March, April- June, July-September, and October-December.
  3. Once a donation has been processed, no funds will be returned to you. All donations to Network for Good are final. Under the tax laws, gifts are irrevocable. In very rare situations, your donation may not be honored for a number of reasons, including: your recommended Charity has lost its tax-exempt status, the Charity is listed on a government or other risk watch list(s), the Charity or NCES school was deemed ineligible by Walmart or Network for Good, or the Charity or NCES school will not accept the funds. If this happens, your donation will be treated as if you recommended a donation to United Way Worldwide.

Spark Good Organization Terms of Use

Spark Good Account

Any use of the Spark Good Account (available at https://www.walmart.com/nonprofits) is subject to Walmart.com Terms of Use and the following additional terms:

i. Access to Spark Good programs

  • To create a Spark Good account, an organization user will need to create or log in with your Walmart.com account. To add organizations to your Spark Good account, these organizations will need to be verified by Deed, a third-party verifier. All additional users will have to be added in Deed, and require a Walmart.com account before they can access the Spark Good account.
  • A Spark Good account provides access to various Spark Good programs based on organization eligibility. To learn more about program guidelines, eligibility and payment providers, visit Walmart.org/SparkGood for more information.

ii.Information Sharing

  1. To provide a seamless user experience and access to Walmart’s Spark Good community benefits, Deed shares an organization’s basic account information, including emails of authorized users, minus any bank account information, with both Walmart Inc. and the Walmart Foundation.   2. Walmart does not share with Deed any personally identifiable purchase history or Walmart.com account activity from our customers, verified active organizations, or their authorized users. For more information on Walmart’s privacy and security policies click here.
  3. Charities and NCES schools acknowledge and agree that they are not entitled to receive, and Walmart will not provide, any identifiable customer information in respect of purchases made from any Spark Good Registry and customer donations made from Spark Good Round Up. In the case of Spark Good customer round up donations, only a unique identifier number and round up amount for accurate reporting purposes are shared with the Charity or NCES school. In the case of customer donations from a Spark Good Registry, only an order number and name (if the customer chooses to share in a gift message) are shared with the Charity or NCES school.
  4. For organizations participating in Spark Good Round Up, Walmart will share your organization nonprofit ID (NPO ID) and anonymized customer Round Up donation details with Network for Good. Click here to learn more about Network for Good Privacy Policy.

iii. Solicitation

  1. Charities and NCES schools agree to make their Spark Good Registry and Round Up searchable on the customer Spark Good site (www.walmart.com/sparkgood) to customers. The organization may elect to make the registry private and available only to those who have a link.
  2. Charities and NCES schools are solely responsible for compliance with all solicitation regulations under each jurisdiction where they promote their Spark Good Registry and Round up, or any portion thereof.
  3. Walmart generally will not promote any organization or an organization’s participation in any Spark Good programs, including Spark Good Registry or Round Up, without a co-venture agreement with the organization in place.

iv. Promotion

  1. Organizations may only promote or link to their Spark Good’s organization profile, Spark Good Round up, or Spark Good Registry on their own website, user-generated content published through a social media account, or page belonging to the organization, offline mailings, or email correspondence, and may only use certain Walmart’s trademarks or logos identified by Walmart, links to the Spark Good’s organization profile, or other Walmart Content Walmart may make available, in all cases in accordance with the following restrictions:
    1. Organizations may not promote or link to the Spark Good organization profile, Spark Good Registry or the Spark Good Round Up, in a way that is misleading, illegal, or confusing to viewers or that does not accurately represent, or which might adversely impact the Spark Good’s reputation.
    2. Organizations may not state, or imply that Walmart funds, endorses, supports, or is otherwise engaged in business with the organization.
    3. Organizations may not request, collect, obtain, store, cache, or otherwise use any account information of, or used by, other Walmart customers.
    4. Organizations may not modify, redirect, suppress, or substitute the operation of any button, link, or other feature of the Walmart Content or the Spark Good’s organization profile.
    5. Organizations may not frame their Spark Good organization profile and Spark Good Registry or any part of it, on their own website, social media account, mailings, or correspondence. Displaying a link in accordance with these Terms will not be considered framing.
    6. Organizations shall at all times use Walmart’s trademarks or logos in a manner consistent with trademark laws.
    7. Organizations may upload their logo/symbol to promote their organization. If the organization chooses to upload, they must not submit any third-party intellectual property unless the organization has permission. By uploading the logo, the organization grant to Walmart a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use that logo in connection with the Spark Good platform.

v. Organization Address

  1. Walmart.com customers may purchase items added by a Charity or NCES school from their Spark Good registry and choose to direct Walmart to deliver them to the organization’s address designated (“List Address”), or customers may choose to deliver the items to the Charity/NCES school directly.
  2. List Addresses provided must be owned or leased by the Charity or NCES school. Charities and NCES schools must promptly update their List Address (and any other information requested by Walmart) if their address changes, or it ceases holding a valid ownership or leasehold interest in the List Address. An agreement with a mail delivery agent or delivery service is not considered a leasehold for purposes of these Terms. By participating in a Spark Good Registry, Charities and NCES schools consent and allow Walmart or any of its affiliates to share the list address with any seller that offers items on a Spark Good Registry that a customer elects to purchase and send to the List Address.
  3. The organization agrees that Walmart may use their address for the purposes of surfacing the organization when a customer is searching by zip code or state. The specific organization’s location will not be shared with the customer.

Your Spark Good Account will connect you to programs based on your organization eligibility. Visit Walmart.org/SparkGood for more information.

Walmart reserves the right to restrict any organization‘s participation in Spark Good programs or suspend access to the Spark Good Account for violation of these Terms, in addition to any other remedies available to Walmart under these Terms or applicable law.
